Welcome to The Crab. These Terms of Service govern your use of The Crab website and your purchase of products through our online store.
By accessing or using our website, you agree to these Terms of Service. If you do not agree with these terms, please do not use our website or place an order.
1. About The Crab
The Crab is an online fashion store offering clothing, footwear, and other fashion products, including one-of-a-kind and pre-loved products.
Products available on The Crab may be supplied by independent sellers located in different parts of Pakistan.
The Crab manages the product listing, pricing, customer ordering process, and coordination of delivery through third-party courier services.
Customers should deal directly with The Crab regarding orders, returns, product issues, refunds/store credit, and customer-service matters.
2. Eligibility
By using our website or placing an order, you confirm that:
- You are legally capable of entering into a purchase transaction; or
- If you are under the applicable age of legal capacity, you have permission from your parent or legal guardian to make the purchase.
- The information you provide is accurate and complete.
- You will use the website only for lawful purposes.
3. Products and Product Information
We make reasonable efforts to provide accurate information about our products, including:
- Brand
- Size
- Color
- Condition
- Material
- Measurements
- Product photographs
- Visible defects or imperfections
Customers are responsible for reviewing the product description, photographs, measurements, size information, and condition before placing an order.
Because many of our products are pre-loved, products may contain minor signs of previous use. Any significant known defects or imperfections should be disclosed in the product listing.
Minor variations in color may occur because of lighting, photography, or individual device and screen settings.
Measurements may also have minor variations because some measurements are taken manually.
4. One-of-a-Kind Products
Many products listed on The Crab are one-of-a-kind products.
Once a product is sold, an identical replacement may not be available.
We therefore cannot guarantee the availability of another item with the same:
- Design
- Brand
- Size
- Color
- Style
- Condition
Customers should carefully consider the product information before placing an order.
5. Product Authenticity and Brand Representation
The Crab makes reasonable efforts to verify products before listing them.
Where a product is represented as an authentic branded product, The Crab aims to ensure that the product is genuine.
Some products may be manufactured in Pakistan or elsewhere and may resemble branded products. Such products must not be misleadingly represented as genuine branded products.
Where applicable, product listings will provide appropriate information regarding the product's brand, origin, nature, or authenticity.
The Crab reserves the right to remove any product if its authenticity, description, origin, or branding is found to be misleading or otherwise unsuitable for listing.
If a product is determined to be counterfeit after being listed or sold, The Crab will take appropriate action, which may include removing the product, addressing the customer issue, and taking action against the relevant seller.
6. Product Availability
All products are subject to availability.
Because products are supplied by independent sellers and are generally one-of-a-kind, availability can change.
A seller is required to immediately notify The Crab if a listed product is sold, unavailable, damaged, or otherwise cannot be fulfilled.
If an item becomes unavailable after an order has been placed, The Crab reserves the right to cancel the order and provide the customer with an appropriate resolution in accordance with our policies.
7. Pricing
The Crab determines the selling price displayed on the website.
Prices may be changed at any time without prior notice.
A price change will generally not affect an order that has already been confirmed, except where an obvious pricing, technical, or listing error has occurred.
The Crab reserves the right to correct pricing errors and cancel affected orders where necessary.
8. Orders
When you place an order, you are requesting to purchase the selected product.
An order confirmation indicates that we have received your order request but does not guarantee fulfillment where the product is unavailable or an error has occurred.
The Crab reserves the right to:
- Accept or decline an order.
- Cancel an order.
- Limit orders or quantities.
- Cancel orders affected by inventory, pricing, technical, authenticity, or listing errors.
If an order is cancelled after an online payment has been received, the applicable amount will be handled according to the applicable refund/payment policy.
9. Customer Information
Customers must provide accurate information when placing an order, including:
- Full name
- Phone number
- Delivery address
- City
- Email address, where applicable
- Any other information required for delivery
The Crab is not responsible for delivery failures, delays, or additional costs resulting from incorrect or incomplete information supplied by the customer.
10. Cash on Delivery
Cash on Delivery (COD) may be available depending on the courier network and delivery location.
Where COD is available, customers agree to pay the full applicable order amount to the courier upon delivery.
Customers who repeatedly refuse or fail to accept COD orders may have their COD option restricted or removed from future orders.
The Crab may also take appropriate action regarding repeated or intentional order refusals, subject to applicable law.
11. Payment
At the time of these Terms being published, The Crab may primarily offer Cash on Delivery.
The Crab may introduce additional online payment methods in the future.
Where online payment methods are available, customers agree to provide valid and authorized payment information.
The Crab is not responsible for payment failures caused by banks, payment providers, card issuers, courier services, or other third parties.
12. Delivery
Orders may be fulfilled through third-party courier services.
Depending on the applicable arrangement, the courier may collect the ordered product directly from the seller and deliver it to the customer.
Delivery availability and estimated delivery times may vary according to:
- Customer location
- Seller location
- Courier network
- Weather
- Public holidays
- Operational circumstances
- Other circumstances outside The Crab's reasonable control
Delivery estimates are therefore not guaranteed unless specifically stated otherwise.
13. Delivery Charges
Delivery charges may apply to orders depending on location, courier availability, promotions, and other circumstances.
The Crab may occasionally offer free delivery for selected products, locations, promotional periods, or orders.
Any applicable delivery charges will be communicated to the customer before the order is completed, where reasonably possible.
14. Inspection Upon Delivery
Customers are encouraged to inspect their order as soon as it is received.
If the product is damaged, incorrect, or significantly different from the listing, the customer must contact The Crab within 24 hours of delivery.
The Crab may request photographs and/or video evidence to verify the issue.
15. Returns, Store Credit and Exchanges
Returns are governed by our separate Return & Refund Policy.
Eligible return requests must be submitted within 24 hours of delivery.
The Crab does not provide cash refunds for approved returns. Where a return is approved, the eligible amount will be provided as store credit, subject to the Return & Refund Policy.
Store credit is valid for 30 days from the date it is issued.
Because most products are one-of-a-kind, exchanges for different sizes, colors, styles, or customer preferences are generally not available.
16. Store Credit
Approved store credit:
- Is issued only after an eligible returned item has been received and inspected.
- Is valid for 30 days from the date of issue.
- May be used toward eligible purchases on The Crab.
- Cannot generally be exchanged for cash.
- May not be transferable unless The Crab agrees otherwise.
Customers should use their store credit within the applicable validity period.
17. Pre-Loved Products
Many products available on The Crab are pre-loved.
Customers acknowledge that pre-loved products may naturally have signs of previous use, including minor:
- Fading
- Wear
- Fabric variation
- Imperfections
- Other characteristics consistent with the product's stated condition
Such characteristics do not constitute a defect when they have been accurately disclosed or shown in the product listing.
18. Seller-Supplied Products
Products listed on The Crab may remain the property of independent sellers until sold.
Sellers provide products and relevant information to The Crab for listing.
The Crab may review, photograph, describe, categorize, price, and list products according to its internal processes.
Customers do not need to communicate directly with individual sellers regarding their orders.
The Crab will handle customer communication and coordinate with the relevant seller when necessary.
19. Seller Product Availability
Sellers are responsible for informing The Crab immediately if a listed product:
- Is sold elsewhere.
- Becomes unavailable.
- Becomes damaged.
- Is no longer in the seller's possession.
- Cannot be fulfilled for any other reason.
If a seller fails to notify The Crab and a customer places an order for an unavailable product, The Crab may take appropriate action against the seller.
Such action may include:
- Removing or suspending the seller's listings.
- Suspending or terminating the seller's participation.
- Recovering applicable operational, courier, or other costs from the seller where applicable.
- Taking other reasonable measures depending on the circumstances.
20. Seller Fulfillment
Once a customer places an order, the relevant seller must make the product available for courier collection in accordance with The Crab's instructions.
If a seller fails to provide an ordered product without a valid reason, The Crab may cancel the order and take appropriate action against the seller, including recovering applicable costs and/or suspending the seller's account or listings.
21. Seller Payments
The Crab's seller commissions, listing fees, margins, and other internal commercial arrangements are separate from these customer Terms of Service and are not disclosed through this policy.
Seller payments are processed after the applicable 24-hour customer return period has expired and after The Crab receives the applicable payment from the courier.
Because COD payments may take time to reach The Crab, seller payments may be processed within approximately one week or longer, depending on courier payment processing, returns, disputes, verification, operational circumstances, and other applicable conditions.
The exact seller payment process is governed by the separate agreement between The Crab and the seller.
22. Seller Verification and Authenticity
The Crab may verify products before listing them.
The Crab reserves the right to reject or remove products that:
- Are counterfeit.
- Are misleadingly represented.
- Have questionable authenticity.
- Contain unauthorized branding.
- Do not meet The Crab's listing standards.
If a seller provides a counterfeit product or materially misleading product information, The Crab may remove the product and take further action against the seller, including suspension or termination.
Where applicable, the seller may be responsible for costs or losses resulting from knowingly or negligently submitting prohibited or misleading products, subject to the separate seller agreement and applicable law.
23. Prohibited Use
You agree not to:
- Use the website for unlawful purposes.
- Provide false or misleading information.
- Use another person's information without authorization.
- Attempt to interfere with the website.
- Attempt unauthorized access to our systems or data.
- Abuse promotions, store credit, refunds, or other offers.
- Use automated systems to scrape or collect website information without authorization.
- Engage in fraudulent purchasing or payment activity.
- Attempt to exploit technical or pricing errors.
24. Intellectual Property
The Crab's name, branding, logo, website design, original photographs, graphics, text, marketing materials, and other original content are owned by or licensed to The Crab unless otherwise stated.
You may not reproduce, copy, modify, distribute, sell, or commercially use The Crab's protected content without prior permission.
Third-party brands, logos, trademarks, and product names remain the property of their respective owners.
25. User Reviews and Submitted Content
If customers submit reviews, photographs, feedback, comments, or other content to The Crab, the customer confirms that the submitted content does not unlawfully infringe another person's rights.
The Crab may use legitimate customer-submitted content for business, website, marketing, or promotional purposes, subject to applicable law and our Privacy Policy.
We reserve the right to remove content that is unlawful, fraudulent, abusive, misleading, or otherwise inappropriate.
26. Third-Party Services
The Crab may use third-party services, including:
- Courier companies
- Payment providers
- Shopify and related technology providers
- Communication services
- Analytics services
- Marketing platforms
These services may have their own terms and policies.
The Crab is not responsible for circumstances caused solely by failures or actions of third-party service providers beyond our reasonable control.
27. Website Availability
We aim to keep our website operational and accessible, but we do not guarantee uninterrupted or error-free access.
The website may temporarily become unavailable because of:
- Maintenance
- Updates
- Technical issues
- Hosting or platform problems
- Security incidents
- Circumstances outside our reasonable control
28. Limitation of Liability
To the extent permitted by applicable law, The Crab will not be responsible for losses caused by circumstances beyond our reasonable control, including courier delays, payment-provider failures, technical failures, incorrect customer information, or other external events.
Nothing in these Terms is intended to exclude or limit any rights or protections that cannot legally be excluded or limited under applicable law.
29. Changes to These Terms
The Crab may update these Terms of Service from time to time.
Any changes will be posted on this page with an updated "Last updated" date.
Your continued use of the website after changes are posted constitutes acceptance of the updated Terms to the extent permitted by applicable law.
30. Governing Law
These Terms of Service shall be interpreted in accordance with the applicable laws of Pakistan, subject to applicable consumer-protection laws and other mandatory legal requirements.
Nothing in these Terms is intended to remove or restrict any rights that customers have under applicable law.
